Report: Napa Valley Unified School District Accused Of Not Stopping Abuse Of Special Education Student

Lawsuit accuses Napa school district and community college of failing to stop repeated sexual assaults of special education student.

NAPA VALLEY, CA — A special education student was repeatedly sexually assaulted by a classmate while enrolled in a Napa Valley Unified School District program, which failed to intervene, according to a lawsuit filed this month, the Press Democrat reported.

The lawsuit alleges that Napa Valley Unified School District staff, including two teachers, did not prevent an autistic teenager’s sexual abuse – including a bathroom assault – by two other students.

The complaint, filed Sept. 4 in Napa County Superior Court, accuses the district of sexual battery, false imprisonment, negligence and infliction of emotional distress. The complaint names the district, two teachers who supervised the program, and Napa Valley College — where one of the alleged assaults occurred — as defendants.

The accuser, identified in court papers as “John Roe,” is described as a high school graduate diagnosed with autism who participated in the district’s transition program, which provides adult supervision and continued education for students with special needs.
