Father Accused of Hit and Run That Injured His Young Son
Police say a hit and run crash left an unrestrained 4-year-old hurt. The father, also the suspect, was found hiding in his backyard.

HERCULES, CA- Police in Hercules are investigating a hit-and-run crash that occurred early Tuesday and allegedly involved a car with a young child inside.
Officers responded at 12:38 a.m. to the 2200 block of Pheasant Drive on a report of a vehicle crash and located an unoccupied Nissan Pathfinder that had crashed into a retaining wall.
The person who reported the incident told police a man and a young child had walked away from the crash. While officers were at the scene, a tow truck arrived and its driver said a resident in the 1200 block of Turquoise Drive requested him, police said.

Officers contacted the residents at the Turquoise address, but the residents denied any knowledge of who was driving the vehicle, police said.
Investigators were able to determine Custodio Gutierrez, 32, was driving the vehicle at the time of the crash, and his 4-year-old son was a passenger in the vehicle, police said. Gutierrez was located hiding in the backyard and was arrested.

Police said the cause of the crash appears to have been excessive speed, and the child was not properly restrained in a child seat during the crash. The child was transported to a hospital for shoulder and stomach pain.
Gutierrez was released to be evaluated for injuries, police said. Police are investigating the crash as a felony hit-and-run and felony child endangerment incident.
