Ask a Trooper: Can Drivers Use Breakdown Lanes to Escape from Traffic Jams?

Public Information Officer Lt. J. Paul Vance of the state police provides answers to your law enforcement questions.

By Jayme Kunze

Reader Question: Is it illegal to drive in the breakdown lane when there is a traffic jam to get off the next exit?

Response from Lt. J. Paul Vance: Yes, it is illegal, even if you are getting off on the next exit. The charge would be “Passing On The Right” and/or “Failure To Drive In Established Lane," both of which are infractions for $132 fines. A break-down lane is just that, a beak-down lane for emergencies. It is not designed or intended for travel.
