The agreement comes just days after Kinner filed a complaint against Ada County prosecutors, law enforcement and jail staff over excessive cell searches.

Ruya Kadir, along with family and friends, were present for the 3-year-old's birthday party at a Boise apartment complex. Kinner was arrested after attacking the girl and others during the celebration. Kadir died from multiple stab wounds sustained during the incident. Eight others at the party were wounded.

Kinner was living with a resident of the complex prior to the incident before he was asked to leave. Kinner and the victims were not known to each other.

Kinner was sent to the Idaho Department of Correction for a mental evaluation after he was ruled incompetent to stand trial. He was found mentally fit to stand trial in October 2019 and was scheduled for a jury trial to begin in September.

A sentencing hearing is scheduled for June 10 and at this time, it is unclear if a sentence of death can been taken off the table in the plea agreement.
