Amtrak Shooter Intended To Kill Conductor: DuPage Judge

The 80-year-old faces time at a mental health facility after a judge said he's, "not not guilty."

NAPERVILLE, IL — Edward Klein, the 80-year-old Wisconsin man accused of shooting an Amtrak conductor in Naperville, was found to be “not not guilty” and “not acquitted” by a DuPage County judge, according to the Daily Herald. Klein faces time at a mental health facility after Friday's ruling. Judge Jeffrey MacKay used the "not not guilty" term, despite a court-appointed psychologist's finding that Klein was unfit to stand trial,

The Daily Herald reported that Klein appeared to “spend much of Friday’s court appearance staring up at the lights and occasionally shaking his head as MacKay discussed his ruling." Klein’s charges include attempted first-degree murder, stemming from a May incident in which Amtrak conductor Michael Case of Homewood, was shot in the abdomen as he stepped out onto the platform at the Naperville station.

Case spent six weeks in the hospital after the shooting, and recently testified in December. The next phase of the detention process begins at 9 a.m. Thursday, according to the Daily Herald.
