Elmhurst Woman Bites Officer, Kicks Another: Cops

"I'll fix my hair before you read me my rights," she was quoted as saying.

ELMHURST, IL – An Elmhurst woman got violent with local officers who responded to a disturbance at her house during the fall, authorities said.

Marissa Bender, 29, who lives in the 800 block of North Willow Street, faces four counts of felony aggravated battery and one count of resisting an officer, records show.

On Friday, Patch obtained the police report through a public records request.

Shortly before midnight Oct. 12, a neighbor on Willow Street called about hearing a fight.

Police said they found Bender hiding by an SUV with an open bottle of Tito's Vodka.

Smelling of alcohol, Bender was covered in dirt, without shoes, and her pants and socks were ripped, according to the report.

Bender told an officer she had drunk too much and went to nearby Doti's Liquors, but it was closed, police said. She said she got into an argument at her house, but then retracted that statement. Her boyfriend was reported to be in the home.

While police checked the area, Bender got into an officer's face and ordered, "Sit the f– down," the report said. The officer, in turn, told her to sit down and that she was not free to leave because she was being detained for prowling.

Instead, Bender was reported to walk away, asking, "Am I arrested?"

An officer grabbed her by her left arm and pulled Bender to the ground, police said. She was repeatedly informed she was being arrested on a charge of obstructing an officer.

Two officers tried to bring Bender to a squad car, while she kicked the legs of one of them numerous times, according to the report.

During a search outside the car, police said Bender bit an officer's right ring finger, with the officer pulling his hand away and saying, "Ow!" She did not break skin, police said.

She is also accused of trying to bite another officer's hand.

During the ride to the police station, an officer noticed Bender had slipped out of her left handcuff. When the officer got out, Bender grabbed the officer's cup from the front because the window partition separating the front and back had not been secured, police said.

Officers escorted a shouting Bender to the lockup, trying to calm her down, police said. They tried to put her in handcuffs, but she resisted by pushing their hands, police said.

As an officer read her rights, Bender said "F– you" and "I'll fix my hair before you read me my rights," according to the report.

She was then taken to the DuPage County Jail
