Car Shopper Hit in Face With Vehicle's Rear Lift-Gate: Lawsuit

The man was shopping for a car in the Phillips Chevrolet showroom when he was hit in the face, the lawsuit said.

FRANKFORT, IL — A prospective car buyer took a shot in the face from a vehicle’s rear lift-gate when a salesman caused it to “violently swing open,” according to a lawsuit filed in Will County court.

Frank B. Martin sued Phillips Chevrolet in Frankfort for the injuries he supposedly suffered while shopping for a car in February 2014.

A salesman “recklessly, negligently and without warning, opened the lift-gate (of a vehicle) and then (released) it while simultaneously instructing (Martin to) walk to the rear of the vehicle to look inside the rear of the vehicle,” the lawsuit said.

After Martin got to the back of the vehicle, the salesman “let go of the opened lift-gate, causing it to fall and strike” him, the suit said.
