Man Dies Months After He's Injured In Silver Spring Shooting

Prosecutors are deciding whether to pursue first-degree murder charges after police said the man was shot by his girlfriend's son.

SILVER SPRING, MD — A Silver Spring man's death is now being investigated as a homicide after he died three months after police said he was shot by his girlfriend's son.

Derrick Jones, 40, was shot on June 19 shortly before 1:15 p.m. while at a residence in the 30 block of Hunters Gate Court in Silver Spring, Montgomery County police said in a statement.

According to police, officers arrived and found Jones suffering from apparent gunshot wounds. Officers provided first aid, police said, and Jones told them that his girlfriend’s son, 20-year-old Julian Rogers of Silver Spring, had shot him.

Jones was taken to an area trauma center for treatment.

A lookout was issued for Rogers, police said. Officers located him nearby and arrested him without incident. A privately manufactured gun with an extended magazine and a live round in the chamber was recovered by police.

Rogers was taken to the Montgomery County Detention Center, where he was charged with attempted second-degree murder and related offenses.

On Sept. 28, Montgomery County homicide detectives were notified that Jones had died while receiving care at a rehabilitation facility. Jones was taken to the Office of the Chief Medical Examiner, where an autopsy was conducted.

On Tuesday, the medical examiner ruled his cause of death a homicide, police said.

The Montgomery County State’s Attorney’s Office is planning to review the case and determine whether to pursue a superseding indictment charging Rogers with first-degree murder.
