Officer-Involved Shooting In Silver Spring Under Investigation

Police continue to investigate the Montgomery County police officer who shot a man at the Stoneymill Square shopping center.

SILVER SPRING, MD — Montgomery County Police on Wednesday released further information regarding the officer who shot and wounded a fleeing suspect in Silver Spring at the Stoneymill Square shopping center Nov. 5. The shooting followed an emergency call to police from a driver who said his car was being rammed by an unknown SUV.

About 8:20 p.m. Sunday, Nov. 5, a 29-year-old man who was driving a 2016 Toyota Camry called 911 to report a 2003 Cadillac Escalade was repeatedly slamming into his car at the Stoneymill Square shopping center at the corner of Veirs Mill Road and Randolph Road.

Police say the first officer who arrived at the scene, Officer Todd Archer, fired his service weapon and shot the 52-year-old man driving the SUV. Officers began life-saving measures and the Escalade driver was taken to a local hospital with serious, non-life-threatening injuries.

Officer Archer is currently on paid, administrative leave, as is protocol. The 10-year veteran officer is assigned to the Patrol Division and works in the 4th District.

  • Collected Officer Archer’s Department issued body-worn camera and reviewed that video.
  • Collected Officer Archer’s service weapon and duty belt for preservation and analysis.
  • Interviewed the person who called 911 (who stated that he was in his vehicle and an unknown SUV was ramming his vehicle).
  • Obtained statements and body-worn camera video from officers who arrived at the scene following the shooting.
  • Canvassed the area for additional witnesses and surveillance video. Investigators obtained long-range video of the event that was captured on a business’ surveillance system.
  • Photographed the scene.
  • Towed the Cadillac Escalade and processed it for evidence. The Escalade has since been returned to the family.
  • Interviewed the family of the male who was shot.

The information gathered by detectives has been given to the Howard County State’s Attorney’s Office for review. The Montgomery County State's Attorney's Office and the Howard County State’s Attorney’s Office have an agreement that when an officer-involved shooting involving injury or death occurs in one county, the other county’s State’s Attorney’s Office will review the event, police said.

The Howard County State’s Attorney’s Office will determine if the Montgomery County police officer acted within the confines of the law.
