Brockton Woman Sues Dunkin' For Severe Burns And Humiliation

The woman says negligence from employees has left her with permanent scars and has had to undergo surgery from hot coffee burns.

BROCKTON, MA — A Brockton woman is suing the owner and two employees of a Dunkin' franchise for $100,000 in damages after she says she suffered severe burns in a drive-thru.

A lawsuit filed in Plymouth District Court at the beginning of the month says the woman had three cups of scalding hot coffee spilled on her legs while employees laughed and pointed at her as she tried to remove her pants to keep her legs from burning.

Angela Barbosa is suing Pembroke-based Cadete Enterprises, owned by John Cadete for the incident that occurred at the Dunkin' on Torrey Street in Brockton.

Barbosa claims she was in the passenger's seat of her sister's car in June 2020 when they ordered three hot coffees.

She says the employee did not properly secure the coffee cups in the tray, and that the drinks were not properly capped, causing the hot drinks to spill all over her, seriously burning her from the waist down.

"Seeing this, the employees were pointing, laughing and mocking the Plaintiff," Barbosa's attorney Charles Kazarian wrote in the lawsuit. "Thus, not only was she burned and in pain as a result of the employee's negligence, she suffered the indignity and extreme embarrassment of being laughed and mocked while in a very vulnerable and exposed condition."

The lawsuit says the hot coffee gave Barbosa severe burns and nerve damage. According to the Patriot Ledger, a mole on Barbosa's backside had to be surgically removed, and "her scars appear to be permanent," Kazarian said.

Barbosa is suing for negligence, negligent infliction of emotional distress, and intentional infliction of emotional distress.

Patch has reached out to the Dunkin' on Torrey Street in Brockton who declined to comment on the matter.
