Clinton Township Woman Convicted of Killing Grandson Denied Fifth Trial

A 63-year-old Clinton Township woman will spend the rest of her life in prison for the murder of her 4-year-old grandson. 

Macomb County Circuit Court Judge Peter Maceroni denied Terry Borgia's request for a fifth trial, CBS Detroit reported Wednesday.

Borgia was convicted in March during her fourth Macomb County Circuit Court trial. Legal issues and a hung jury led to three previous mistrials. She was found guilty of felony murder and first-degree child abuse. A third count of involuntary manslaughter was dismissed prior to jury deliberations, according to court records.

Borgia was accused of drowning DeAngelo Tobia, in January 2010 in the bathtub of her Clinton Township apartment. At the time of his death, Borgia was living with her daughter Tonina. Prosecutors said there is no evidence to charge Tonina, despite claims by defense attorney Mark Haddad that Terry Borgia has been covering for her. 

Tonina, DeAngelo's aunt, was previously found to be an unfit witness due at trial to mental health issues, CBS reports.
