2 Bars, 1 Name: The Battle of the Bernie's May End in Court

An Amherst Street business called Bernie's may have to defend its good name in court, after a lawsuit filed by a Hampton Beach business, also named Bernie's.

What's in a name? A NH court may have to decide that one in the case of the two restaurants with the same name.

The owner of Bernie's Beach Bar in Hampton has filed a lawsuit in Rockingham Superior Court to stop a former colleague from maintaining the current name and logo style of  a similar Nashua establishment, Bernie's on Amherst Street, according to the Union Leader.

The Union Leader has reports that Al Fleury, who also owns Wally's Pub at Hampton Beach, has filed for an injunction against Bernie Goulet and Goulet's Nashua concert venue and restaurant, called Bernie's. 

Goulet used to work as a music promoter at Wally's Pub until two years ago, and the Union Leader has reported that Fleury filed the suit after Goulet allegedly didn't respond to cease and desist letters sent in August and September.

Bernie's Beach Bar opened in May after Fleury tore down La Bec Rouge, which was heavily damaged by a burst pipe, and constructed a new restaurant, bar and music venue that specializes in outdoor entertainment.
