Mercer Man Faces 30 Years In Prison For 2022 Shooting Incident

On Feb. 5, Davion S. Smith was convicted by a jury of aggravated assault and weapons charges, authorities said.

MERCER COUNTY, NJ — A Mercer County man was convicted earlier this week for his role in connection with an August 2022 shooting incident, Mercer County Prosecutor Janetta D. Marbrey said.

On Feb. 5, Davion S. Smith, 26, was convicted on all counts of the indictment, including unlawful possession of a handgun, possession of a firearm for an unlawful purpose, aggravated assault, and certain persons not to possess a firearm.

Smith is scheduled to be sentenced on April 4. At that time, he will face a sentence of up to 30 years because the jury found him eligible for sentencing to an extended term under New Jersey’s “Persistent Offender” statute.

Around 1:30 a.m. on Aug. 13, 2022, Trenton Police responded to the 100 block of Oakland Avenue on a report of shots fired and saw a vehicle, driven by Smith, leaving the scene at high speed. A search of that vehicle resulted in the recovery of a defaced .38 caliber revolver, Marbrey said.

Surveillance video from area of the shooting showed Smith firing a handgun in the direction of a separate vehicle before he fled the scene, authorities said.

The investigation was led by the Mercer County Shooting Response Team and Detective Sarai Cheek of the Trenton Police Department.
