Moorestown Manufacturer Sued by Competitor

Albion Engineering, a caulking gun manufacturer, was sued in federal court by a competitor for alleged false claims about where its products are made.

A caulking gun manufacturer in Maryland has sued a local competitor for allegedly falsely claiming its products are made in the United States.

Newborn Bros. Co., Inc. filed a suit Thursday in federal district court in Camden accusing Albion Engineering, located at 1250 North Church St., of violating the federal Lanham Act and state law by “misleading distributors and consumers for years using false claims that Albion’s products are ‘Made in USA’ when Albion actually sells products imported from Taiwan,” according to a release sent out by Newborn.

The Maryland-based manufacturer seeks an injunction to stop Albion’s “deceptive sales, recall and destroy false advertising materials … and award payment of damages from the unfair competition.”

According to Newborn’s release, the Federal Trade Commission restricts the use of the “Made in USA” label to products that are “virtually all” made in the United States.

Albion owner Mark Schneider dismissed Newborn’s claims, saying Albion has a longstanding reputation for making quality products and that none of their products are actually labelled “Made in USA.”

He declined to comment further on the details of Newborn's lawsuit, but indicated the suit was without merit. 

Albion has been in business since 1929 and moved to Moorestown in 2005, Schneider said.

A call to Newborn Bros. was not immediately returned Thursday.
