United Water Developer Wants To Know If Any Officials Attended Anti-Development Group's Meeting

The attorney representing the potential developer of the United Water property has asked that New Milford officials be polled to see if they or their family members attended the first meeting of a .

Antimo "Andy" DelVecchio, who represents the Hekemian Group in the , argues in a letter dated May 11, 2012 that a conflict of interest could arise if the mayor or any member of the Council or zoning board -- or a member of their immediate family -- attended a meeting of the group SOD

At the opening of Thursday evening's special meeting of the Zoning Board of Adjustment, board attorney Scott Sproviero read DelVechhio's letter into the record.  

"Since the Zoning Board of Adjustment sits as a quasi-judicial body, we believe that if any member of the Zoning Board of Adjustment or their family members attended such a meeting, that a conflict may have developed," the letter states.

Board Attorney Scott Sproviero said that the letter raised a "legitimate question" and polled the members of the board, each of whom said that neither they, nor any member of their immediate family, attended any meeting of SOD.

DelVecchio stated in his letter that should there be a conflict between any member of the Zoning Board, the Mayor and Council or any member of their family, the applicant would request that the member recuse themselves from the hearing.
