Teaneck Police Assist in New Milford Sexual Assault Arrest

Investigation leads to arrest of New Milford man, police say.

NEW MILFORD -- A borough man was arrested early Sunday morning on sexual assault charges for allegedly trying to force a woman to engage in sex with him against her will. 

Chief Frank Papapietro said that Daniel E. Hernandez-Garcia, 25, was arrested at his apartment in the Brookchester Apartment complex on River Road after police responded to complaints of a noise disturbance from neighbors at approximately 5 a.m. Sunday morning.

Papapietro said that the victim, also 25, informed responding officers, Daniel LaMorges and Derek Mattessich, that upon returning home from a party in New York City that they attended together, Hernandez-Garia tried to force her to have sex with him against her will.

"The victim resisted his attempts for approximately 25 minutes," Papapietro said.

Hernandez-Garcia was taken to the  where, after being interviewed by Detective Brian Long, he was arrested and charged with attempted sexual assault, criminal restraint and simple assault, police said. Long was assisted by Sgt. George Molina from the  who served as translator.

Superior Court Justice James Guida set bail for Hernandez-Garcia at $50,000 with no 10 percent option. He is being held in the Bergen County Jail in lieu of bail.
