Judge Rules On Some Evidence In Fatal Wayne Crash: Report

A judge ruled some evidence inadmissible in a case against a driver charged following a fatal crash on Route 23 in Wayne, a report says.

WAYNE, NJ – A judge declared some evidence inadmissible in a case against a driver charged following a fatal crash last year at a Wayne gas station on Route 23, according to a report.

While the charges of vehicular homicide and manslaughter will stand against Jason Vanderee, a superior court judge ruled that statements he made to a detective after the crash won’t be heard during trial because he seemed to be too stoned to have consented to an interview after the crash, NJ.com reported.

The judge also ruled that Vanderee's prior conviction for driving under the influence in November 2016 would be admissible in court if the case went to trial, the report says.

Vanderee was subsequently charged with three counts of death by auto and aggravated manslaughter, as well as driving while intoxicated. He was also charged with several drug-related offenses, including possession of hypodermic needles, authorities said.

In July, the Glenwood man rejected a plea deal from the state that would have sent him to serve three, 15 year terms in jail.
