Mom, Baby Hospitalized After Eating At NJ McDonald's: Lawsuit
The mother and her child became severely ill after eating "dangerously defective" chicken products, the lawsuit claims.

PATERSON, NJ — A woman claims she and her young child needed to be hospitalized after eating food from a McDonald's in Paterson, and has sued the restaurant owner for negligence.
The lawsuit states that Yuleisi Montero ordered a crispy chicken sandwich and some nuggets when she was at the Broadway restaurant with her baby son, in July of 2022. After eating, she and the child became severely ill and ultimately suffered "serious and permanent personal injuries" that had lasting effects, according to court documents.
McDonald's corporate offices did not reply to Patch's request for comment by press time.

This lawsuit was filed on July 2, 2024 in Passaic County Superior Court against franchise owner Iris W. Henderson, LLC, who operates the restaurant. The owners are accused of failing to "use reasonable care to ensure the preparation and/or distribution of food fit for human consumption, free from all diseases, (and) kept reasonably and properly to protect patrons."
The restaurant acted "negligently and carelessly" in serving Montero and her child food that was "in a dangerously defective condition," the lawsuit claims.

The plaintiffs requested a jury trial, and are seeking monetary damages for court fees and to recoup the cost of the family's medical care. Patch also reached out to Montero's attorney for further information.
