And The Schlitt Law Firm pointed out, “If you want to make sure the pothole gets fixed, put it in writing to the Town Clerk’s office. Be specific about the location. This puts the Town on notice about the pothole and they face liability if they fail to fix the pothole. By the way, NY State law exempts the State form pothole liability during the winter. Crazy.”
