Prison Sentence For Lindenhurst Man Who Raped, Abused Daughters: DA

Years later, they told their mother, who called the police, the district attorney said.

LINDENHURST, NY — A 42-year-old Lindenhurst man has been sentenced to 30 years in prison for raping one daughter when she was 12 and sexually abusing his other daughter when she was 8 years old, Suffolk County District Attorney Ray Tierney said Monday.

His attorney, John Halverson, Esq., said an appeal is in the works.

Neither the DA’s Office nor Halverson is naming the man, in order to protect the identities of the children.

The evidence at trial established that in early 2016, the man went into a room where his then-8-year-old daughter was resting, the DA said. He sexually abused the child and then told her to clean herself up afterward and watched as she showered, Tierney said. That daughter did not disclose the abuse until 2021, when she told her mother what had occurred, the DA said.

Following that disclosure, the man's older daughter told the mother that in April 2013, when she was 12, her father raped and sexually abused her, Tierney said.

Their mother contacted the Suffolk County Police Department, and the man was arrested. Following his arrest, the man sent the mother a letter indicating that he was sorry for what he had done, the DA said.

On Sept. 8, a jury found him guilty of the following charges:

  • One count of Rape in the First Degree, a Class B violent felony;
  • One count of Criminal Sex Act in the First Degree, a Class B violent felony;
  • Two counts of Sexual Abuse in the First Degree, a Class D violent felony;
  • One Count of Criminal Contempt, a Class A misdemeanor.

On Dec. 18, Judge Karen M. Wilutis sentenced him to 30 years in prison, followed by
20 years of post-release supervision. He will also be required to register as a sex offender, the DA said.

"Let this prison sentence for rape and sexual abuse be a warning to anyone that if they seek to harm children in Suffolk County, they will end up behind bars," Tierney said. "My office will do everything in our power to ensure that justice is served and that our children are protected from individuals who would prey on minors."
