Cops: Man, 43, Drives Drunk, Nearly Strikes Gas Station Patron

A Hess gas station patron in Yorktown reported to police that the man was driving recklessly in the parking lot and nearly struck another patron before fleeing the scene.

A 43-year-old man is due in court Tuesday night to answer charges of drunken driving in Yorktown and nearly striking a gas station patron, Yorktown police said. 

Gerard J. Oleary, of Connecticut, was charged with driving while intoxicated, aggravated driving while intoxicated, and second-degree reckless endangerment, misdemeanors.

A Hess gas station patron reported to police on May 4, at around 9:39 p.m., that a driver of a red Dodge Challenger was driving recklessly in the parking lot and nearly struck another patron before fleeing the scene, police said.

Oleary's vehicle was then seen traveling east-bound on Crompond Road and the man was stopped in the parking lot of Yorktown High School. Investigation revealed the man was driving while intoxicated and created a "substantial risk of serious physical injury" to another person, police said. 

He was arrested at the scene for driving drunk and reckless endangerment. He was transported to police headquarters where he was additionally charged with aggravated driving while intoxicated following a breath test.

Oleary was issued traffic summons and served with a temporary order of protection. The man was released on $250 bail and was scheduled to appear in Yorktown Town Court on May 7.
