Montco Man Gets State Prison Term For Supplying Fentanyl That Killed User

Kevin Foraker, 41, will spend up to 42 months in state prison for supplying the Fentanyl that killed Brian Lang, 37, of Lower Providence.

LOWER PROVIDENCE, PA — A Montgomery County man was handed a state prison sentence of between 18 and 42 months after he pleaded guilty in connection with charges relating to the 2020 overdose death of a man who died a result of using the Fentanyl provided by the defendant.

Kevin Wayne Foraker, 41, of West Norriton Township, was sentenced on Monday by Montgomery County Common Pleas Court Judge Thomas C. Branca, according to court records.

Foraker had pleaded guilty to charges of involuntary manslaughter and possession with intent to deliver fentanyl, an opioid that is stronger and more lethal than heroin.

According to the criminal docket sheet in the case, Foraker had originally been facing a more serious charge — a first-degree felony count of drug delivery resulting in death — but the judge allowed that charge to be changed to the less serious involuntary manslaughter, which is a first-degree misdemeanor.

Foraker was given a sentence of three to 12 months on the involuntary manslaughter charge, and a sentence of 15 to 30 months on the possession with intent to deliver charge, however, records show that Branca ordered the two sentences to run consecutively, not concurrently.

Foraker was originally scheduled to be sentenced in April, but sentencing was subsequently pushed to June.

Patch previously reported on the case, in which Foraker was charged after he supplied Fentanyl to Lang, his co-worker, who ended up dying in May 2020 as a result of a drug overdose.

Both Foraker and Lang had worked together at a party rental business in the Norristown area.
