Dad Of Smothered Infant Heads To Trial On Third-Degree Murder Charge

TRAPPE, PA — A Montgomery County man has been ordered to stand trial on third-degree murder and related charges in connection with the smothering death of his infant son.

David Moyer, 24, of Trappe Borough, was held for court following a preliminary hearing recently before Magisterial District Court Judge Cathleen Kelly Rebar, according to court personnel.

Records show that the hearing took place in Collegeville on July 12.

Moyer has been held on $1 million bail since his arrest this spring.

Moyer is being charged with felony third-degree murder, a felony count of endangering the welfare of children, and a misdemeanor count of recklessly endangering another person.

Patch contacted Rebar's office Monday who confirmed that following the July 12 preliminary hearing, Moyer was held for court on all three of the criminal charges.

During a preliminary hearing, a lower court judge determines whether there is enough evidence for a criminal proceeding to advance to the Common Pleas Court, or trial court, level.

A district court employee said that a formal arraignment at Montgomery County Common Pleas Court is scheduled for Aug. 24.

A trial date would likely be scheduled at that time.

Medical examiners had determined that Moyer's infant son died of blunt impact injuries, and the manner of death was ruled a homicide.

Moyer reportedly left the child face-down on the bed for 20 minutes and later took the child in an Uber to a local emergency room, according to county prosecutors.
