Settlement Reached In Phoenixville Takeover Of Small Tract
Council approved a settlement with Fillmore Village that prevents Fillmore from contesting the borough's decision to take over the land.

PHOENIXVILLE, PA — Phoenixville Borough Council Tuesday night unanimously approved a settlement with Fillmore Village Community for the borough to take over a 2,363 square-foot plot of land off Ashburn Road for an emergency access road.
Under the agreement, the borough will pay the Association $14,455 to waive its rights to contest the borough’s decision to condemn the road.
The borough is in the process of acquiring the land through eminent domain, a legal process that allows the government to take over a property.

The land is required to provide adequate access for emergency vehicles to the Odessa Development, which has not yet been constructed.
The Odessa development calls for a three to four-story apartment building with 224 units and a parking garage for 351 spaces, and commercial space on the first floor.

The development will also have 166 stacked townhomes, 20 surface lot spaces, and 70 street spaces.
