Former Edmonds police officer Daniel Timothy Lavely was convicted Thursday of having sex while on duty with a woman he had detained, the Everett Herald reports.
Lavely, 48, testified during the trial that he never had sex with the woman although he admitted lying about other events on May 7, 2012.
The 28-year-old woman alleged that on May 7 at about 2:30 a.m. Lavely had sex with her while she was in custody in a deserted parking lot on Highway 99 in Edmonds, according to court documents.
Lavely was charged in November and found guilty of first-degree custodial sexual misconduct, a felony. At the time of the incident Lavely had been a 7½-year employee of the Edmonds Police Department assigned to the patrol division. He resigned in January after the department finished an internal investigation.
As the conviction was read, he shook his head, the Herald reports, and his girlfriend reportedly dropped to her knees. He faces up to a year in jail and must register as a sex offender for 10 years. He is free until sentencing set for Sept. 23.
