Fremont Condo Complex Pays Up After Prohibiting Kids From Playing

A local homeowners' association apparently prohibited kids from playing outside. Now, the group has to pay families.

FREMONT, CA -- A Fremont homeowner association apparently prohibited kids from playing outside. Now, the group has to pay families over that rule. The homeowner association, Silvertree Mohave, agreed recently to pay $800,000 for prohibiting children at the Sequim Common to play outside, according to KPIX.

The settlement comes after families filed a class-action lawsuit stating Silvertree Mohave "adopted a 'no sports play' rule, which prohibited any children under the age of 14 from being in the complex’s common areas without adult supervision, and from engaging in any 'sports activities' in the common areas," according to the lawsuit. The rule was implemented in 2000.

Domenica Lewis, a former resident of the complex, told the news station that the HOA warned fines would be issued for any families that allowed their kids to play outside. Lewis also said she received threats from HOA board members.

“It was rough, it was a lot of harassment, it was a lot of limitations for them not having a place to go to and play,” Lewis told the news station. "Harassment, filming, video recording my kids, taking pictures of my kids."

The $800,000 settlement means each family will receive about $2,300, the news station reported.
