GA Judge Dismisses 2 Charges Against Donald Trump In Subversion Case

A charge against one of former President Donald Trump's co-defendants was also dismissed in Fulton County, media reports say.

ATLANTA, GA — A Fulton County judge has dismissed two charges against former President Donald Trump and another charge against a co-defendant in an election interference case in Georgia, Reuters reported Thursday.

Fulton County Judge Scott McAfee ruled Georgia prosecutors lacked the authority to bring forth the charges that stemmed from accusations of false documents being filed in federal court, the news outlet reported.

Specific details regarding who the third count was dismissed for was not immediately known.

“Because Counts 14, 15, and 27 lie beyond this State’s jurisdiction and must be quashed, the Defendants’ motions to dismiss the indictment under the Supremacy Clause are granted in part,” McAfee wrote in his decision, NBC News reported.

The entirety of the 41-count indictment was not tossed, the news outlet reported.

Trump, a Republican, has been accused of trying to interfere with the 2020 presidential election, during which he lost the race to current Democratic President Joe Biden. Trump and 18 others were indicted on several charges in August 2023 after being accused of trying to overturn the election results in Georgia.

“President Trump and his legal team in Georgia have prevailed once again,” Trump's attorney Steven Sadow said in a statement Thursday regarding McAfee's ruling, per NBC. “The trial court has decided that counts 15 and 27 in the indictment must be quashed/dismissed.”

Trump was initially charged on suspicion of violation of the Racketeer Influenced and Corrupt Organizations Act, three counts of solicitation of violation of oath by public officer, conspiracy to commit impersonating a public officer, two counts of first-degree conspiracy to commit forgery, two counts of conspiracy to commit false statements and writings, conspiracy to commit filing false documents, filing false documents and false statements and writings.

However, McAfee quashed on March 13 six counts of solicitation of violation of oath by public officer against Trump, Giuliani, Meadows, Cheeley and attorneys Ray Smith and John Eastman.

The case against Trump remains at a standstill as an appellate court is set to consider an appeal in December to remove Fulton County District Attorney Fani Willis, both Reuters and NBC reported.

McAfee determined in March that top prosecutor Nathan Wade or Willis and her office should leave the case due to the appearance of impropriety relating to the pair's romantic relationship.

The judge said there was no "actual conflict" due to their relationship, which would have disqualified Willis. Wade ultimately resigned from the case.

Trump, who is seeking to secure a second term in the Nov. 5 general election, had his first debate Tuesday against challenger Vice President Kamala Harris. Harris filled the race's Democratic slot after President Joe Biden bowed out of the race in July.

An official court date has not been set for Trump in the Georgia case.
