No Charges Filed After Boy, 5, Hit And Killed In St. Charles Driveway

The 5-year-old boy died after being hit by a car in the 4000 block of Royal Fox Drive. Police say a family member was driving the car.

KANE COUNTY, IL — No criminal charges will be filed in connection with the death of a 5-year-old St. Charles boy who was fatally hit by a car in his driveway last week, authorities said Wednesday.

Following an investigation into the incident, which happened on May 27 in the 4000 block of Royal Fox Drive, the Kane County State's Attorney's Office determined the immediate family member who was driving the vehicle would not be held criminally responsible.

“This was a heartbreaking and tragic accident that has devastated a family and deeply affected the community,” said Kane County State’s Attorney Jamie Mosser. “After a comprehensive review of the evidence, it is clear that this was not the result of criminal conduct, recklessness, or negligence. It was a moment that no family member of a loved one should ever have to experience."

Police said the person who hit the child — an immediate family member — cooperated with their investigation.

On Wednesday, Rich Clark, deputy chief with the St. Charles Police Department, said local police are also giving the death of the boy.

“Our entire Police Department and all First Responders grieve alongside the family and friends affected by this tragic accident,” Clark said. “This tragedy greatly touched our entire community, and our young resident will continue to forever be in our hearts and minds.”

Emergency responders first at the scene of the collision found a neighbor administering CPR to the boy. Police and paramedics continued to perform life-saving measures before transporting the child to Northwestern Medicine Delnor Hospital where he was later pronounced dead, according to police.
