Controversial 24-Unit Bayville Apartment Complex To Go Before Board Again
The Tallwood Way apartment complex, which faced fierce local opposition last year, will return to the zoning board for site plan approval.

BERKELEY, NJ — A controversial three-story, 24-unit apartment complex on Tallwood Way in Bayville will go before the Zoning Board of Adjustment again this month for site plan approval, nearly a year-and-a-half after it received initial approvals.
Developers will be seeking final site plan approval for the building at the meeting. They also want approval to build it 38 feet tall, when 35 feet is the permitted height, according to public notice.

However, that denial was invalid, as an ineligible board member voted. So a new vote was held the next month, and this time, it passed. Read more: New Vote Held On Tallwood Way Variance In Berkeley
It was a bifurcated proposal, meaning a site plan approval would be voted on at a later date. That date is now the Sept. 24 zoning board meeting.

The apartment complex drew controversy as residents feared exacerbating existing drainage issues in the area. It also is proposed close to the existing Tallwoods Care Center, igniting fears regarding traffic issues.

However, that lawsuit was dismissed at the beginning of 2025 due to lack of prosecution, according to court documents.
Meeting attendees will have the chance to learn more about the application and voice their thoughts on it.
The meeting is set for Sept. 24 at 6:30 p.m. in the Berkeley Township Municipal Building (627 Pinewald Keswick Road).
