The Appellate Court ruled 3-0 in favor up-holding Judge Ford's decision granting South Seaside Park it's right to de-annex from Brekeley Township. The Appellate Court ruled citing Berkley Township was biased with their witnesses and township officials. They also stressed the financial hardship for the remaining Berkeley Township residents would be minimal.
Berkeley Township has 20 days to appeal this decision to the NJ Supreme Court.
