Loose Dunkin' Lid Gave Berkeley Man 2nd Degree Burns, Lawsuit Says
The Berkeley resident said Dunkin' Donuts was negligent in attaching the lid, spilling hot coffee on his lap and burning his skin.

TOMS RIVER, NJ — An Ocean County man is suing Dunkin' for negligence after a loose lid on a cup of hot coffee caused it to spill into his lap and gave him second-degree burns, he claimed.
The lawsuit, filed in Ocean County Superior Court, says that Berkeley resident Cosimo Nistico ordered a cup of coffee at a Dunkin' drive-thru on Route 37 in Toms River this past April.
But the lid on the coffee cup was not secured properly, and the hot coffee spilled onto his lap and gave Nistico second-degree burns on his left thigh, according to the lawsuit.

This caused Nistico "great pain and suffering," required medical attention and made it difficult for him to pursue his normal activities, the lawsuit said.
Named in the suit is Dunkin', along with several unnamed employees and corporations.

Nistico is requesting a trial by jury and compensatory damages.
Other lawsuits against Dunkin' involving hot beverage spills have been filed in Morris, Passaic, Bergen, Camden, and Burlington counties, Patch has previously reported.
Dunkin' did not immediately respond to a request for comment.
