Preventative detention motion was denied for this case, and six months later defendant was charged with first degree murder

Yesterday evening a jury found Luis Chaparro guilty of shooting at or from a motor vehicle, with a firearm enhancement, and criminal damage to property. The trial lasted four days and Chaparro could face up to four years in prison for these convictions. Sentencing will take place in January.

Chaparro committed this crime in January of 2020. The Bernalillo County District Attorney’s Office filed a preventative detention motion, and it was denied a month later. The court found that Chaparro was a danger to the community but that conditions of release would be sufficient to protect the community from his dangerousness. Despite those conditions of release, Chaparro was charged with first degree murder and aggravated battery only a few months later. The first degree murder case is currently pending trial.

“While we were disappointed we were unable to detain this individual, I am pleased with yesterday’s verdict as my team and law enforcement agencies worked together to prove this case,” said Bernalillo County District Attorney Raul Torrez. “We are prepared to go forward with the homicide charges against Mr. Chapparo to seek justice for Mark Williams and his family, and will continue to work towards improving the pretrial detention system.”
