‘Commack Cemetery in non compliance even after a extension granted by NYS Division of Cemetery’

Update on Commack Cemetery NYS Division of Cemetery. Anyone with families in Commack Cemetery’s please be informed of the NYS Division of Cemetery Full Investigation that is in process.

•NYS Division of Cemetery granted an extension but Commack Cemetery’s failure to comply to file documents can get them a $500.00 per day “violation fine” for non-compliance?

•NYS Division of Cemetery has Commack Cemetery under investigation because of the numerous complaints lodged against it. The cemetery’s Board has no “Treasurer” and has not issued lot owners its annual financial statement. No Treasurer and without voting with Board have withdrawn funds for expenditures and that may be including salaries.

•Elected officials Honorable 12 District Leslie Kennedy, Honorable Suffolk County Controller John Kennedy and NYS Investigator Kerry McGovern all in attendance.

•The Commack Cemetery board operated without following by laws or the Robert Rules.

•Trustee Arlene Goscinski bellowed out during a non-ballot election “NOT DONEGAN!” J E Donegan is the Suffolk County Cope Program Captain of The Official Smithtown Neighborhood Watch a notable public figure. Donegan is no stranger to NYS Cemetery Law. He is well educated and informed on NYS Cemetery Law as Donegan was the point person at Woodlawn Cemetery Susan Olsen for the Friends of Harkness Family. Mr. Donegan oversaw the communication at Woodlawn Cemetery with the Commonwealth Foundation, Harkness Ballet and the Harkness families.

•Mr. Donegan rightfully won his Trustee seat but Trustee VP Mitchel Hirsh , Esq., (conflict of interest) along with Jeana Foggia a Trustee and paid secretary employee pulled the second seat that Ronald Denezzo resigned from and deceived the lot owners? Staging the meeting with a switcheroo? Then an allegation non lot owner by deed won a seat? Followed up of alleged wage thief as one Trustee who clocked in to be paid. Under the Commack Cemetery by laws the trustee is a volunteer. Trustee claimed she was working when in fact she clocked in before the “lot owners meeting.”

•Additionally, there were people present that voted that were not “lot owners and allegedly ran for Trustee?”

•NYS Investigator informed Board Mitchel Hirsh VP that this was a lot owners meeting and Donegan was not cross examining lot owners and he has the right to ask questions. Donegan punch 🥊 out the Board and questioned New York State Investigator for clarity. Which NYS Division of Cemetery Kerry McGovern clarify “DONEGAN” was correct on it all.

•One lot owner filed a complaint of wrongful burying their love one in the wrong grave.

Obligations to the Government violated?

•Commack Cemetery returns to Suffolk 4th District Court on July 22, Tuesday with McCarthy Landscaping for 9 Pines “healthy” trees illegally taken down without Smithtown permits.

•Moreover, Trustee Arlene Goscinski, in a Commack Cemetery Appeal letter, mispresented the cut down trees as being “diseased” & damaged by the weather after the lot owners meeting. All misrepresentation as The Town of Smithtown investigation negates this claim #TREEGATE

•At the lot owners meeting, it was clearly understood and established the Pines Trees were healthy and Legislature Leslie Kennedy said the drainage issues with sewers have been a problem for years and look outside today it’s still flooding. The Pine Trees absorb the water and Commack Cemetery lost its rural allure of beautification.

•NYS Division of Cemeteries has found Commack Cemetery not in compliance with their requests for documentation of expenditures.

•A lawsuit has been filed and Commack Cemetery needs to get a lawyer. Mitchel Hirsh, Esq. VP on Board has a “conflict of interest” and his opinion of cemetery law failed Commack Cemetery? Charging a 501 c3 professional fees? This entire Commack Cemetery Board & Trustees needs to step down. The disrespect for the burial of dead is so egregious it is being addressed by Director of NYS Cemetery Louis Polishook.
