I won my Commack Cemetery trustee seat.
A “Commack Trustee Lot Owners” meeting was staged.
Why was a non lot owner Marybeth Heberer Medolla listed as a trustee on a Federal 990 IRS Form in 2024 and ran against me in 2025?!
Mitchel Hirsch Vice President flowery email to NYS Director Lewis Polishook stated, he invited Marybeth Heberer Medolla (which Marybeth denied in her resignation letter?) to Commack Lot Owners meeting (which lot owners meetings weren’t done for 30 years keeping lot owners in non transparentstate of minds.)
Why did her father retired Superintendent William Heberer accept two (2) Emeritus payouts for $7,500.00 each. This is a misuse of “PUBLIC FUNDS?” When NYS Division of Cemetery Investigator Kerry McGovern made it clear on the first payout it was illegal but it continued? Why was the $15,000.00 not returned to Commack Cemetery?
Moreover, the Commack Cemetery ran an a board without a Treasurer and illegally took votes after assembly of board trustees to pillage the coffers? A board of Trustees that recirculated themselves to block new lot owners from joining with bullying tactics?!
Additionally, Vice President Mitchel Hirsch ask for votes after a board meeting weeks later to repave the roadway in the cold weather to take $28,000.00 without a board vote approval during a legal assembly board meeting using email?
Why did Commack Cemetery Board have Ted McCarthy Landscaping (also in Suffolk County District 4 Court now with Smithtown) destroyed the Pine barrier forestry, destroyed the ecosystem, the water flow from Huntington into Smithtown into New York State Open Land and changed the grade without Smithtown permits for a French sewer drain? Permits for the drains are still outstanding!
How can these board members Supervisor Gerard Cespuglio and Trustees not step down after all this incompetence with Superintendent Gerard Cespuglio who is an employee and was put on the board as a trustee against the Commack Cemetery by laws? All can be sued individually for violating their fiduciary duty. Time for all to get their own lawyers as the Insurance Company can deny a claim when there is suspected criminal malfeasance?!
Gerard Cespuglio knowingly took down the Pine forestry destroying the eco system that the Pine trees absorb the water,and the overflow nourishes NYS Open Land property abutting Commack Cemetery to Fox Lane and Jericho Turnpike. Whistleblower past Superintendent Julia Minerva states, “I told Jerry he could not take the Pines Trees down and the Board.”
Gerard Cespuglio is a non-lot owner, Commack Cemetery by laws prohibits a non-lot owner to be a Trustee, was installed into Superintendent position without a Assembly of The Board vote to release Julia Minerva from her Superintendent position and vote Gerard Cespuglio in, Superintendent Julia Minerva was brought into a garage to be fired before a board meeting by President James Walker & Gerard Cespuglio without any valid reason. The stellar service of Superintendent Julia Minerva, the Commack Cemetery Secretary and the Superintendent warned Gerard Cespuglio the Pine Trees cannot be removed and Commack Cemetery needed to apply for permits from the Town of Smithtown and Huntington.
The pattern shows alleged wrongdoing and misuse of funds, ill-gotten gains from conflict of interest using the Old Boy network way of receiving illegal referral fees and dereliction of duty?!
Commack Cemetery illegally removed the Pine tree forestry and received violations for removal of the eco forestry system. The scheduled court date is in January at the Suffolk County 4th District Court .
Smithtown has mandated the replanting of the Pine Tree forestry which was the boundary line of the towns of Smithtown and Huntington.
NYS Division of Cemetery Investigator Kerry McGovern had complaints of cremation remains buried in a wrong grave?! Allegations of Ted McCarthy Landscaping taking a full-sizedump truck to back fill graves and dumping several yards of dirt too high. Then dropping the dirt that caskets echo loudly and were damaged in the burial process?!
Why did President James Walker who did admit in a Commack Cemetery Board meeting he had Trustee Arlene Goscinski write a Memorial Appeal Letter stating the Pines trees were diseased and weather beaten and put Arlene to perjury herself signing the letter?
When the President James Walker admitted his wrongdoing “WHY” did he not be a gentleman and step down?
Which brings us to Mitchel Hirsh Vice President wrongdoing, and he stated his wrongdoing and did not step down? C. Mitchell Hirsch is running the cemetery as his own province" is an idiom used to suggest that he is managing the cemetery with absolute and often self-centered control, acting as though he is a local sovereign rather than an administrator accountable to others.
Mitchel Hirsch protested too much to NYS Director of Cemeteries Lewis Polishook. Which brought NYS CHARTIES Bureau Karen Goldman to refer the case to Attorney General Latisha James Deputy Jill Fink Faber and Suffolk County District Attorney Ray Tienry’s Office is waiting for a referral of criminal charges.
Below is an email from Mitchell Hirsch Regarding the matter:
Dear Director Polishook,I am writing in response to your earlier email. Please be advised as follows with regard to items 4-8 of your letter of July 30, 2025. #4. A verified report to lot owners has not been provided for our meeting on April 26, 2025. With regard to our meeting of February 3, 2024 I lack sufficient information and belief to respond. I have been unable to interact with our current Secretary Ms. Minerva as we are in litigation with her and she is represented by counsel. She may or may not have filed that report without the Board’s knowledge. Of course, we will take all necessary steps to furnish the above reports. #5. I am unaware of any letters or emails of resignation of any officers and or directors after February 28, 2025. #6. We did invite Marybeth Medolla-Heberer, daughter of longtime President William Heberer to serve on our Board on or about February 3, 2025. She was nominated and stood for election against lot owner John Donegan at the annual meeting. Ms.Medolla-Heberer received the majority of votes cast. Treasurer David Cotter resigned from his position during 2025. Jeana Foggia was elevated to the board during 2025. Ron Dinezzo, a longtime Board member, took a leave of absence from the Board due to serious illness. However, he has not resigned and remains in good stead. #7. Please see #6 above. #8. I am unaware of any conflict of interest statements or disclosures having been filed for 2024 or 2025. As stated above, these are filings that are historically made by our Board Secretary. Regrettably, our secretary may have submitted these filings, but I do not have any personal knowledge as to whether that was done.Our Board thanks you once again for the patience and courtesies shown by your office to us during this very difficult time. “Clearly there is a negative history that preceded me showing a desire to be on the board. This is something that I have no desire to be pulled into. I had no part in any forms being filed with the IRS and no conversations were ever had about me being a member of the board prior to me raising my hand showing interest.”
Who’s telling the TRUTH?! Marybeth Hebener Medolla, Mitchel Hirsch, both or neither?! Let you the reader read in between the misrepresentation's and outright lies here?!
Accountability is to have these two infamous men, President James Walker & Vice President Mitchel Hirsch that have control Commack Cemetery for “30 years” recirculating board and trustee member’s and accusing board members and trustees of grandstanding, pontification and non-civility to step down immediately?!
Assistant Secretary Jessica stepped down after being asked to “sign blank checks?!” Jessica, the volunteer assistant, did not comply and resigned immediately.
Then brought back a Trustee Ron DeNezzo who resigned in the meeting minutes and elected him, Treasure? All due to a confrontation with Gerard Cespuglio and Treasurer David Cotter who resigned?! Why? To control the Commack Cemetery checkbook for ill-gotten gains out of operational cost account?
Alleged embezzlement, kickbacks, a pattern of grabbing money without filing major alterations plans to NYS Division of Cemetery, a slush fund for the Board, conflict of interest and an illegal firing of whistleblower Superintendent Julia Minerva? Who filed a lawsuit. Witnesses are Suffolk County Controller John Kennedy, 12 District Legislator Leslie Kennedy and NYS Division of Cemetery Kerry McGovern to Mitchell Hirsh grandstanding, pontification, no civility and attacking me at a Board meeting stating, “you are your own worst enemy and you will have to go to court get your trustee seat!” All recorded in the Commack Cemetery Minutes and video.
No NYS Cemetery Board negates Mitchell Hirsch stance,and the alarm bells are ringing alleged corruption. 12 District Leslie Kennedy said, Mitchel Hirsch jumped up and verbally attacked Mr. Donegan and Mitchel Hirsch arse was in my ‘FACE!’ Unacceptable!”
Sadly, for Mitchel Hirsch NYS had my back and Cemetery Board Deputy Jill Fink Faber has taken the case for a full investigation under NYS Attorney General Latisha James.
The case is now referred from NYS Division of Cemeteriesto Charities Bureau to Cemetery Board for an audit and full investigation.
I won my trustee seat and now I am the Commack Cemetery Trustee.
Suffolk County Comptroller John Kennedy stated, “Mr. Donegan there’s blood in the water and NYS Cemetery Board is now investigating.” 12 District Legislator stated, “look outside this Commack Cemetery window. The voice of all that are buried under these monuments are to be heard and protected.” May God have Mercy on these Board & Trustees failed fiduciary duty.
