A probation officer had agreed to support the release if Doe's lawyer turned over identification documents under seal that prove he who he is. His lawyer also pointed out that he has a stable home, a girlfriend, and four children.

Even after Doe's lawyer provided documentation, prosecutors expressed worry that he would flee.

Judge Stacie Beckerman said that while she understood the government's frustration with not being able to confirm his identity, she saw no evidence that he was seeking to flee or get a passport to commit crime.

John Doe is due back in court for trial in November.
