Pizza Delivery Driver Charged with Second DUI
Police said the 34-year-old Portsmouth man asked the officer who pulled him over to keep his drinking and driving "a secret."

PORTSMOUTH, RI—A pizza delivery driver for a Middletown pizza restaurant was slapped with his second driving under the influence charge after he was pulled over by Portsmouth police early Sunday morning.
Morgan Sampaio Moffa, 34, of 86 Birchwood Drive, Portsmouth, was arrested at around 3:30 a.m. after he failed a field sobriety test, according to a police report.
Moffa was stopped on East Main Road after Middletown police alerted Portsmouth dispatch about a possibly intoxicated driver in a gold Toyota RAV4.

A Portsmouth officer caught up with the vehicle, driven by Moffa, a short time laterand pulled him over after several traffic violations were observed.
Once stopped, Moffa said he was coming from Pizza Hollywood in Middletown and had one beer before leaving work. He reportedly told the officer "But shhh, that can just be our secret."

The officer reported smelling alcohol and asked Moffa to submit to a field sobriety test, which he initially declined, insisting that he "only lives two minutes away" and that the officer "should just follow him home."
The officer said that that he would not be followed home and managed to get Moffa to take the test, which he failed.
A search of Moffa's car turned up three open and empty cans of Rolling Rock beer and three empty 50ml bottles of Fireball whisky in the trunk area of the SUV. ANother two unoped cans of beer were located behind the driver's seat.
Moffa refused a chemical test while in police custody. As a result, he was charged with refusing a chemical test in addition to the DUI charge.
Moffa was released on cash bail and is due to be arraigned on March 31.
Moffa's first DUI charge was in Newport in 2013 after he crashed into an iron fence at Rough Point, the former seaside home of Doris Duke. He eventually pleaded no contest and his license was suspended for 30 days. He was also ordered to complete 40 hours of community service and attend DWI school in addition to paying a fine.
In that incident, he also begged police to be left of easily, apologizing for the crash and promising not to do it again if he was let go.
According to that police report, Moffa reportedly said "I can't believe I put people's lives in danger."
