Narragansett Police Log: August 17, 18 and 19, 2012

A man with just a suspended license charge gets assault tacked on after allegedly assault police officers.

Unless otherwise noted, information about the following incidents was supplied by the Narragansett Police Department. An arrest does not indicate a conviction.

Two Arrested After Speeding Stop

Cody L. Harvey, 24, of 83 Pershing Ave., South Kingstown, and Frederick Eugene Butler, 25, of 280 Washington St., Providence, were arrested at about 4:45 p.m. on Aug. 19.

According to police, an officer monitoring traffic noted a Mazda being driven by a white man with red hair pass his car near Starr Drive West on Boston Neck Road. Police said the officer turned around and followed the car, and clocked it at 56 miles per hour in a 40 mile per hour zone.

Police said the officer couldn’t make a traffic stop at the time because of heavy traffic, but followed the car to the Maury Loontjens Memorial Library parking lot. The officer noted that the car’s occupants – the driver and two passengers – all went into the Comfort Station.

According to police, a passenger was the first one out of the bathroom, and she told police that Harvey was driving. Police noted that Harvey momentarily left the bathroom, saw the police car by his car, and then quickly tried to re-enter the bathroom.

Police said they told Harvey to exit the bathroom, which he did after a few seconds. Police said that during questioning, Harvey became argumentative and confrontational, and denied driving the car.

A background check revealed that Harvey’s license was suspended on July 11, for failing to pay a fine related to a tailgating charge.

The other passenger in the car – Butler – had a Sixth Division District Court warrant out for his arrest, for failing to appear at a court hearing on June 26 related to a Providence police charge of possession of marijuana.

According to police, Butler was arrested without incident. He was unable to make bail – $4,685, due to various charges – and was transferred to the ACI at 6:49 p.m.

However, police said that Harvey was uncooperative throughout his arrest and booking.

Police said when Harvey was put in the back of the police car, he began kicking the center portion of the car’s cage and screaming, “You ****ing cops! **** you!”

According to police, when they arrived at headquarters, Harvey told them, “I’m going to kick your ****ing ass when you open the door.” Police said when they did open the door to the car, Harvey refused to come out, and had to be forcibly pulled from the car.

Police noted that Harvey resisted and struggled throughout the booking process, and struck two officers with his feet during it. As a result, two charges of assault were added to the charges against him, in addition to the suspended license charge.

Because of concerns about officer safety, police said they left Harvey’s handcuffs on him during processing. Police noted that Harvey screamed and yelled throughout, with remarks like, “You are a ****ing rookie cop!”

Harvey was charged with driving with a suspended license and two counts of assault. He was also cited for speeding. He was processed and then released at about 9:55 p.m. His car was towed and his license was also confiscated.

South Kingstown Man Arrested for Warrant

Sean M. Laboeuf, 21, of 3985 Kingstown Road, South Kingstown, was arrested at about 2:31 a.m. on Aug. 19. Police said Westerly police issued a warrant for Laboeuf’s arrest for shoplifting.

According to police, an officer traveling behind a Chevrolet Blazer on Point Judith Road noted that the rear license plate appeared to be missing. A traffic stop was made in the 700-section of Point Judith Road.

Police said that during the stop, a temporary plate could be seen on the rear windshield. However, a background check of a passenger – Laboeuf – revealed the warrant.

Laboeuf was arrested without incident. Westerly police picked him up from headquarters at about 4 a.m.
