Narragansett Police Log: October 4, 2012

A Warwick man is charged with drunken driving, second offense.

Warwick Man Charged With Drunken Driving

Matthew A. Myers, 25, of 132 Brunswick Drive, Warwick, was arrested at about 1:33 a.m. on Oct. 4 and charged with drunken driving second offense within five years, and cited for refusing to submit to a chemical test.

According to police, an officer traveling behind a white sedan on Boston Neck Road noted it swerving and randomly applying its brakes. The officer clocked the car at 25 miles per hour in a 30 mile per hour zone, and then again at 25 miles per hour in a 40 mile per hour zone by Old Boston Neck Road.

Police said a traffic stop was made as the car attempted to travel the wrong way on Ocean Road near Narragansett Town Beach. Police noted that the car finally stopped at the intersection of Ocean Road and Beach Street.

According to police, Myers smelled strongly of alcohol and couldn’t locate his vehicle’s registration info. Police said he consented to field sobriety tests, which he failed after claiming he couldn’t do one portion because “my left ankle is sprained and I got a high ankle sprain on my right ankle and poison ivy.”

Police arrested Myers after he refused to take further field sobriety tests. According to police, when they asked him to submit to chemical breath tests, he told them, “I’m not taking the test but I’m not refusing the test either.”

Police told him that not providing an answer was the same as a refusal. Police noted that he refused to sign the form stating that he refused to take the test.

Police said when they attempted to do an alcohol influence report with him, he told them, “I’m not giving you any answers.” Police said Myers also refused to sign his traffic court summons.

According to police, a check of Myers’ criminal history revealed a no contest plea to a Warwick police charge of refusing to submit to a chemical test in December 2007. As a result, Myers’ drunken driving charge was elevated to a second offense.

Police said Myers was transferred to Fourth Division District Court for arraignment at about 9 a.m.
