2 Guilty Pleas In Separate Manslaughter Cases In Fairfax
Two Fairfax County men pleaded guilty to manslaughter charges related to the fatal shooting of an 87-year-old woman and a 14-year-old boy.

FAIRFAX, va — Two Fairfax County men pleaded guilty to manslaughter Monday in two separate cases, according to Commonwealth's Attorney Steve Descano.
In the first case, 20-year-old Ismael Cruz Delcid of Herndon pleaded guilty to voluntary manslaughter in the death off 14-year-old Westfield High School student Michai Malave, an acquaintance, WJLA reported.
On March 20, 2024, Cruz Delcid was in his car in a parking lot on Coppermine Road when he spotted two teens he knew and gestured them over. As they approached the vehicle, Cruz Delcid put a loaded firearm in his waistband and got out of the car, according to court records.

"The three had a conversation, which escalated, and after separating himself from the two teens, Cruz Delcid fired three shots, two of which struck (Malave) in the neck and chest," according to court records. "Cruz Delcid immediately fled into the nearby woods, where he disposed of the firearm and his clothing, before taking the Metro and an Uber to his girlfriend’s residence and smashing his phone to avoid being tracked. He turned himself into FCPD the next day."
The case against Cruz Delcid ended in a mistrial last June due to a hung jury, court records say. He will return to court on Jan. 6, 2026 for sentencing, when he'll face a possible sentence of up to 10 years in prison for the manslaughter charge.

“My heart breaks for the victim’s family,” Descano said. “His parents deserved the chance to see him graduate high school and pursue his dreams. He had his whole life ahead of him, and I hope that this conviction allows everyone who knew him to continue healing from this terrible loss.”
In the second case, Douglas Summer pleaded guilty to voluntary manslaughter and unlawful discharge of a firearm in the fatal shooting of his wife, Marilyn Sommer.
On Feb. 28, 89-year-old Douglas Sommer shot his 87-year-old wife at close range, while she was sleeping in a recliner chair inside their Chantilly home, according to court documents. Both Sommer and their daughter, who was in a different room in the house, called 911 to report the shooting.
"When Fairfax County first responders arrived, Sommer calmly stated that he killed his wife and showed them where the gun was located on their couch, before he was taken into custody," according to court records. "Their daughter had been at the family home that day to help her parents move into an assisted-living facility; she later told police that her father did not want to move."
Sommer is due back in court on Jan. 9 for sentencing, when he'll face a potential sentence of up to 10 years in prison for the manslaughter charge, and up to five years for the firearm charge, according to the commonwealth attorney's office.
“Marilyn Sommer’s long life ended in her own home, at the hands of her own husband,” Descano said. “This is a tragic outcome for the whole Sommer family.”
