Marietta Man Wanted In Connection With VA Killing Arrested, Faces Fugitive Charge: Cops

MARIETTA, GA — A Marietta man was arrested Thursday in connection with a Virginia homicide, according to the Marietta Police Department, and now faces a felony charge of being a fugitive.

Around 4 a.m. Thursday, a Marietta police officer stopped a man — now identified as Yarue Montgomery — who was parked behind a closed business for suspicious activity, and discovered he was wanted in Virginia in connection with a killing investigation.

However, Montgomery's arrest warrant only allowed for in-state arrest, which is unusual for a serious charge, MPD spokesperson Chuck McPhilamy told the Marietta Daily Journal.

"Normally, anything this serious would be a nationwide pickup, and that's why it threw us off so bad," he told the news outlet.

The MPD officer tried calling the arresting agency — Spotsylvania County Sheriff's Office — but since it was 4 a.m., no one answered. Montgomery hadn't broken any laws, so he couldn't be arrested, but the officer made his colleagues aware of the incident.

Around 7 a.m., another officer found Montgomery parked in a different business parking lot. The officer stopped him and kept trying to call the SCSO's office, until finally someone answered.

"[He] eventually reached the detective and verify VA DID want the suspect picked up and would extradite. The suspect had started driving away by the time the change to the warrant was finalized," MPD officials said on Facebook.

It's unclear what charges Montgomery faces in Virginia. A Spotsylvania County Sheriff's Office receptionist said she wasn't authorized to release his arrest warrants to a reporter, she told the MDJ.

Police then conducted a traffic stop on Montgomery, 42, and he was arrested without incident. He was charged with fugitive from justice, a felony, and booked into the Cobb County jail without bond, pending transfer to Virginia.
