Nesbitt was arrested following an operation conducted by Polk County police and member agencies of the Georgia Bureau of Investigation Internet Crimes Against Children Task Force. The operation targeted those who possessed and distributed child pornography and "those who are sexually exploiting children in other ways using technology and the internet," Polk County police said.

Numerous digital devices were reviewed, and police ended up seizing a mobile phone and a laptop. Along with Polk County and Sandy Springs police, other agencies taking part in the operation include the U.S. Department of Homeland Security and the police departments of Rockmart and Floyd County.

Polk County Jail records show Nesbitt was booked into its facility on Thursday, Dec. 20 on three counts of employ/use of minor to engage in/assist person in sexual explicit conduct for visual medium. He remains held without bond.
