Newport: Take 2: Video Shows 'Victim' Had Knife
Video evidence prompted police to bring new charges after a fight on March 1 at Festival Field.

NEWPORT, RI — Irving M. Davila, 34, of Newport, was arrested at 1:10 p.m. Monday, a month and a day after he reported a crime to police and allegedly cast himself as the victim. Back on March 1, Davila called police to say he had been assaulted at Festival Field. According to the arrest report, he was in the parking lot and working on his car, when two men arrived. One hit him with a pink baseball bat. Davila tried to grab the bat and suffered a fracture to his left hand.
Police arrested the man with the bat. He was initially charged on March 30 with felony assault.
But the second man had taped the fight on his cellphone. The tape showed the bat attack was in self-defense, and Davila had been the aggressor. Davila allegedly had tried to attack the victim with a knife.

He was charged with felony assault (with a dangerous weapon) and Disorderly Conduct, which is a misdemeanor.
